Domestic Abuse

The courts in Virginia take domestic abuse very seriously. If there is an evidence of any kind of abuse, the courts are more likely to issue a Protective Order against the abuser. In the beginning, a Preliminary Protective Order is issued, which can be ex parte (in the absence of the other party). A hearing on a Protective Order is then scheduled within fifteen days of entry of the Preliminary Protective Order. The alleged abuser is served and expected to appear in front of the judge to defend himself or herself. If the alleged abuser does not appear after the service, the court may issue a Protective Order for two years. The court may also enter an order for the abuser to pay the necessary expenses of the household member during the entire period of Protective Order. It is therefore, very important to appear at the Protective Order hearing.
