Do I really not have to go to court? +

In most uncontested divorce cases in Virginia, neither party has to appear in court. All documents are submitted to the court by mail or electronically. The court reviews the paperwork and issues the final divorce decree without requiring a hearing. Ms. Khan will advise you if your specific case requires any court appearance — but for the vast majority of uncontested divorces, it is not required.

What is included in the flat fee? +

Our flat fee covers the preparation of your Separation Agreement, Property Settlement Agreement, all required court documents, filing fees, and coordination through to your final divorce decree. You will know the total cost before you retain us — no hourly billing, no surprise invoices. If you retain us on the same day as your consultation, your consultation fee is credited toward the flat fee.

Does my spouse need to hire their own attorney? +

Your spouse does not need to hire a separate attorney for an uncontested divorce, though they are always welcome to do so. Ms. Khan represents you — not your spouse. In an uncontested matter where both parties are in full agreement, both spouses simply need to review and sign the documents that are prepared.

Do both of us need to be Virginia residents? +

No. Only one spouse needs to be a Virginia resident to file for divorce in Virginia. The other spouse can live anywhere — in another state or even another country. Virginia courts have jurisdiction as long as one party has been a Virginia resident for at least 6 months before filing.

Can I sign everything electronically? +

Virginia courts accept electronic signatures on many divorce documents, making it possible to complete the entire process without printing or mailing anything. We also offer online notary services — a notarized document can be completed via a secure video call. For documents that require in-person notarization, we have an on-site notary at our Fairfax office and can accommodate each party at separate times.

How long does an uncontested divorce take in Virginia? +

Once the required separation period is complete and all documents are signed, most uncontested divorces finalize within 30 to 90 days depending on the court schedule. The separation period is 6 months with no minor children and a signed separation agreement, or 12 months if you have minor children. We file as soon as your documents are ready and move as efficiently as the process allows.

What if we have children — can we still do an uncontested divorce? +

Yes, as long as you and your spouse agree on all child-related issues — legal custody, physical custody, visitation, and child support. If you are in full agreement on parenting arrangements and financial support, an uncontested divorce with children is straightforward. The separation period is 12 months rather than 6 months when minor children are involved.

What happens if we disagree on something during the process? +

If a disagreement arises — even on one issue — the divorce may no longer be fully uncontested and a different approach may be needed. Ms. Khan will advise you honestly if this happens and explain your options. Many couples with minor initial disagreements are able to resolve them quickly and still complete the divorce on an uncontested basis.
